Your use of this website is subject to the following Terms and Conditions of Use and our Privacy Policy (collectively the “Terms”), and any other laws or regulations which apply to this website. If you do not accept these Terms, you must refrain from using this website.
We may revise and update these Terms at any time and your continued usage of this website means you accept those changes.
PRICES
All prices are displayed in Australian Dollars (AUD). We reserve the right to make changes to pricing at any time and without notice. All prices displayed are inclusive of GST.
PRODUCT AVAILABILITY & INFORMATION
Due to popularity or interruption of supply, some items may be unavailable or out of stock. We liaise with all of our suppliers on a regular basis to maintain stock availability on our database. Whilst we display an estimated wait time for out of stock products, actual availability is not displayed on our site. Information relating to accurate wait times can be communicated via email. Where an order has been placed without a prior enquiry, we will display an estimated delivery time on the tax invoice. Where we have received notification of discontinued products, we will withdraw the product from the online boutique as soon as possible. If you have specific requirements that must be met such as critical dimensions and colour matching, you must provide the relevant specifications prior to confirming the order. Le Chamarel will not be held liable or obliged to refund any amounts in the event we have not accepted any variations to products in writing prior to the confirmation of your order. Please note that slight variations may occur with regards to size and colour from shipment to shipment which is due to the nature of manufacturing and in some instances hand-made pieces. Additionally some items may require self-assembly and will be stated in the product description.

CONSUMER GUARANTEES
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or a refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
To the full extent permitted by law, all warranties, conditions and other terms express or implied by statute, custom or common law are excluded. Nothing contained in these Terms excludes or restricts any consumer guarantee, warranty, condition, right or remedy implied by any statute (including the Australian Competition and Consumer Act 2010) which cannot be excluded, provided that, to the extent that the statute permits, Le Chamarel is entitled to limit is liability as set out below for a breach of a guarantee, condition or a warranty implied by that statute.
If a product has a minor defect, we will provide a repair or offer you a replacement or a refund. If a product has a major defect, you are entitled to:
• reject the goods and receive a refund;
• reject the goods and receive a replacement, if one is available; or
• keep the goods and receive compensation for the drop in value caused by the problem.
WARRANTY
All product warranties are consistent with Le Chamarel’s suppliers’ warranty policies. Please note that some items purchased may have a back to base warranty, which means that you must cover the cost of freighting the item back to the supplier for repair or replacement. Copies of our suppliers’ warranty policies are available upon request.
DELIVERY & FREIGHTING / DAMAGES
Le Chamarel will coordinate delivery of products, unless agreed otherwise in writing. Some of Le Chamarel’s suppliers will cover the cost of collecting damaged items and freighting replacements. In other cases, the customer may be required to take full responsibility for any freighting costs which may arise and agree to any terms or conditions that our suppliers have in reference to their freighting policy. Copies of our suppliers’ freight policies are available upon request. In the case of any dispute, Le Chamarel will endeavour to facilitate the resolution of any disputes between the supplier and the customer however, Le Chamarel will not take responsibility for any financial loss, fault, delay or breach of guarantee or warranty by the manufacturer. Due to the nature of furniture transport, incidents may occur including damage during transport or late shipment. We will endeavour to quote accurate estimated time of arrivals (ETA’s) however if any unforeseeable delays do occur, Le Chamarel will keep the customer informed as we receive updates. We cannot be held responsible any such unforseen delays. If a product arrives damaged, it is the responsibility of the customer that Le Chamarel is notified via email within 24 hours with clear detailed photos and descriptions of the reported damage. In some instances, the customer may also be required to include a personal assessment on whether damage most likely occurred during shipment or prior to dispatch from our supplier.
COLOURS ON THE WEBSITE
Le Chamarel has made every effort to display as accurately as possible the colours of our products that appear on our online boutique. However the lighting used when photographing products can alter the color and they may appear lighter or darker than in person. Please note that the actual colours you see may also depend on your monitor and settings.
RETURNS & ORDERING
Goods must be paid for in full prior to dispatch. It is your responsibility to take care of ensuring that your order is accurate.
Returns and refunds are subject to the discression of Le Chamarel. Please note that full refunds will be assessed on a case to case basis. Should you decide to cancel an order, it is not always possible for Le Chamarel to refund your deposit.
Custom made product orders require a non-refundable 50% deposit to commence production.
Any product exchanges which incur a freight costs must be paid by you prior to delivery.
Re-delivery fees may occur if the customer arranges a time with the freight company and they are not able to receive the goods as initially arranged. In certain circumstances, Le Chamarel may issue a credit note for exchanges, however Le Chamarel will only issue a credit note to the value of the cost price of the returned item.
All sale items are non-refundable and non-exchangeable unless the goods are faulty or damaged and that fault was not disclosed prior to purchase.

USE OF ANONYMOUS INFORMATION
Le Chamarel automatically gathers anonymous information to monitor the use of our website such as numbers and frequency of visitors. This collective data helps us determine how much traffic use is visiting our site, so we can make improvements and offer relevant information & services to as many users as possible. We may publish or provide this aggregate data to other people.
USE OF PERSONAL INFORMATION
Le Chamarel will use the personal information which the customer has chosen to provide us with solely for the purpose for which it has been provided. Le Chamarel will not use it for any other purpose without the customer’s consent. We might on occasions, use this information to notify you of any important changes to our site or any special promotions that may be of interest to you unless requested otherwise by you.
Any information we may collect from you will be treated with strict confidentiality. The National Privacy Principles, the Privacy Act and general law place strict requirements on us to treat certain information collected as confidential.

Le Chamarel may be required by law to disclose the information, or Le Chamarel may be required to disclose your personal information to third parties to provide the service you have requested, for example, if you purchase products online, Le Chamarel will need to disclose your personal information to third parties in order to bill and deliver your products.
